Subject: Gibraltar aviation (Title VI, Articles 90-100 of the Treaty on the Functioning of the European Union)
Further to my Written Question P-009055-14 on Gibraltar of 11 November 2014 (the answer to which I waited for at least two months, contrary to Rule 130(5) of Parliament’s Rules of Procedure), does the Commission consider that the provisions of Title VI, Articles 90-100 of the Treaty on the Functioning of the European Union apply to Gibraltar?

In accordance with Article 355(3) TFEU, the Treaties apply to the European territories for whose external relations a Member State is applicable. This provision applies to Gibraltar, as has been confirmed by Declaration n° 55 by the Kingdom of Spain and the United Kingdom of Great Britain and Northern Ireland, annexed to the Final Act of the Intergovernmental Conference which adopted the Treaty of Lisbon which states: ‘The Treaties apply to Gibraltar as a European territory for whose external relations a Member State is responsible. This shall not imply changes in the respective positions of the Member States concerned’.
