Asunto: Incidencia en la red Natura del accidente entre buques en la costa de Gibraltar
La Directiva «Hábitats» tiene por objetivo contribuir al mantenimiento de la biodiversidad de los Estados miembros. En la mañana de hoy un diario español señala que en las próximas horas se descargarán en las aguas frente a Gibraltar, con el fin de alterar esta costa, toneladas de piedras procedentes del norte de África.
¿No considera la Comisión que se trata de una infracción de dicha directiva por tratarse de una zona LIC (lugar de importancia comunitaria) del Estrecho Oriental?
¿No cree la Comisión que este hábitat de interés comunitario de tal riqueza biológica —clasificado con el número 1110— por sus bancos de arena cubiertos permanentemente por agua marina poco profunda, arrecifes, estructuras submarinas causadas por emisiones de gases y cuevas marinas sumergidas o semisumergidas, así como por la presencia de especies de interés comunitario como el delfín mular, la tortuga boba o la marsopa común merece la adopción de medidas inmediatas para evitar males irreparables?

De conformidad con la Directiva sobre los hábitats[1], España debe establecer objetivos y medidas de conservación para la zona especial de conservación «Estrecho oriental»[2] con el fin de garantizar su protección efectiva. También debe establecer medidas para evitar el deterioro de los hábitats naturales y de los hábitats de especies, así como las alteraciones que repercutan de manera significativa en las especies que hayan motivado la designación del lugar.
Corresponde a las autoridades españolas cumplir las obligaciones derivadas de la Directiva sobre los hábitats, así como realizar análisis o definir estrategias respecto al tráfico marítimo y su impacto en el Lugar. La Comisión vela por que todos los lugares de importancia comunitaria se designen como zona especial de conservación y estén adecuadamente protegidos. A este respecto, cabe señalar que la Comisión incoó un procedimiento de infracción contra España[3] por no haber designado lugares de importancia comunitaria como zona especial de conservación y no haber establecido objetivos y medidas de conservación adecuados, en particular en «Estrecho oriental».
Durante el período transitorio posterior a la retirada del Reino Unido de la UE, el Reino Unido y la UE aplicaron las disposiciones del Acuerdo de Retirada y, especialmente, del Protocolo sobre Gibraltar, que forma parte integrante del Acuerdo, sobre cooperación en materia de medio ambiente y el Memorando de Entendimiento celebrado entre el Reino de España y el Reino Unido. Las negociaciones en curso entre la UE y el Reino Unido con respecto a Gibraltar abarcan la protección del medio ambiente y tienen por objetivo garantizar un nivel elevado de protección del medio ambiente en torno a Gibraltar. La posición negociadora de la UE deja claro que debe incluirse tanto la protección de la naturaleza como la protección del medio marino.

Subject: Impact on Natura 2000 site of shipping accident on the coast off Gibraltar
Two ships collided in the Bay of Gibraltar at the end of August: the OS 35 hit the Adam LNG as the latter was manoeuvring to move out of the Bay. The OS 35 is now lying semi-submerged off the coast of Gibraltar. Its cargo of lubricating oil has already been removed, but oil was spilt in a special conservation area, namely site of Community importance ES6120032 ‘Estrecho Oriental’.
The Commission has conveyed to the Spanish and UK Governments the need for them to cooperate to protect marine biodiversity in the waters around Gibraltar.
- 1.What action has the Commission taken to ascertain, assess and protect the area affected by this accident, besides asking the countries concerned to cooperate?
- 2.Has the Commission ever commissioned an analysis and assessment of maritime traffic in the Gibraltar Straits and its impact on the site of Community importance, and does it have a strategy for this?
- 3.Bearing Brexit in mind, what agreements and measures are in place between the Commission, the UK Government and the authorities in Gibraltar to protect biodiversity in the area as required by Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora?

Under the Habitats Directive[1], Spain has to establish conservation objectives and measures for the Special Area of Conservation (SAC) “Estrecho oriental”[2] to ensure their effective protection.
It also has to establish measures to avoid deterioration of the habitats and the habitats of the species as well as significant disturbance of the species for which the site has been designated .
It is for the Spanish authorities to implement the obligations stemming from the Habitats Directive as well as any analysis or strategy on maritime traffic and its impact on the Site.
The Commission ensures that all Sites of Community Interest are designated as SAC and adequately protected. In that respect it should be noted that the Commission opened an infringement procedure against Spain[3] for its failure to designate Sites of Community Interest as SAC and to establish adequate conservation objectives and measures, including in “Estrecho oriental”.
During the transition period following the withdrawal of the United Kingdom,(UK) from the EU, the UK and the EU applied the arrangements provided in the Withdrawal Agreement, including a Protocol on Gibraltar which is an integral part of the Agreement.
This included cooperation on environmental matters, and the application of a memorandum of understanding agreed between UK and Spain.
The ongoing negotiations between the EU and the UK in respect of Gibraltar cover environmental protection, with the aim of ensuring a high level of protection for the environment around Gibraltar. The EU negotiating position makes it clear that this should include both nature and marine environment protection.
