Asunto: Expolio de recursos del Sáhara Occidental

Según informa la organización Western Sahara Resource Watch, el barco Key Bay, registrado en Gibraltar, habría llegado el 17 de septiembre al puerto francés de Fécamp con aceite de pescado proveniente de los Territorios Ocupados del Sáhara Occidental, probablemente importado por la compañía Olvea para su comercialización en la Unión.

La sentencia del TJUE del 10 de diciembre de  2015 negó la validez del tratado comercial con Marruecos relativo a este tipo de productos por incluir, ilegalmente, al Sáhara Occidental en su ámbito de aplicación. La sentencia, recurrida, pero no suspendida, ha sido avalada recientemente por el abogado general del TJUE, en cuanto que confirma que el Reino de Marruecos carece de soberanía sobre el Sáhara Occidental según el Derecho internacional.

De confirmarse este episodio, se trataría de una grave violación de la decisión de la Unión y del Derecho internacional.

1. ¿Ha contactado la Comisión a las autoridades francesas sobre la llegada del barco Key Bay desde el Sáhara Occidental?

2. ¿Tiene constancia de que se haya interrumpido el flujo de importaciones del Sáhara Occidental en aplicación de la sentencia del TJUE del 10 de diciembre de  2015?

3. ¿Qué medidas está llevando a cabo para asegurar el cumplimiento de la sentencia del TJUE?

La sentencia del Tribunal de Justicia de la Unión Europea (TJUE) dictada el 21 de diciembre de 2016 concluye el procedimiento incoado contra la Decisión del Consejo relativa a la celebración del Acuerdo Agrícola entre la UE y Marruecos. El TJUE estimó el recurso de apelación interpuesto por el Consejo de la Unión Europea y anuló la sentencia del Tribunal General dictada el 10 de diciembre de 2015.

La Decisión del Consejo relativa a la celebración del Acuerdo Agrícola con Marruecos sigue siendo, por lo tanto, válida. Mientras tanto, las instituciones de la UE están estudiando atentamente todas las implicaciones de la sentencia del TJUE.

La UE reitera su apoyo a los esfuerzos del Secretario General de las Naciones Unidas por alcanzar una solución política justa, duradera y aceptable para ambas partes, que contemple la autodeterminación del pueblo del Sáhara Occidental en el marco de acuerdos coherentes con los principios y objetivos de la Carta de las Naciones Unidas.

Subject: Plundering of Western Sahara’s resources

The Western Sahara Resource Watch organisation has reported that the Key Bay vessel, registered in Gibraltar, docked on 17 September at the French port of Fécamp with fish oil from the occupied territories of Western Sahara. The oil was probably being imported by the company Olvea for sale in the European Union.

The CJEU judgment of 10 December 2015 ruled that the trade treaty with Morocco concerning products of this kind was not valid, since Western Sahara was included, illegally, in its scope. The judgment, which is the subject of an appeal but has not been suspended, has recently been endorsed by the Advocate General of the CJEU, who confirmed that the Kingdom of Morocco has no sovereignty over Western Sahara under international law.

Should the above report be confirmed, this would constitute a serious violation of the European Union’s decision and of international law.

1. Has the Commission been in contact with the French authorities concerning the docking of the Key Bay vessel from Western Sahara?

2. Does the Commission know whether the flow of imports from Western Sahara has been halted pursuant to the CJEU judgment of 10 December 2015?

3. What steps is it taking to ensure that the CJEU judgment is complied with?

The CJEU judgment issued on 21 December 2016 concludes the legal proceeding brought against the Council Decision on the conclusion of the EU-Morocco Agricultural Agreement. The CJEU upheld the appeal brought by the Council of the European Union and set aside the judgment of the General Court delivered on 10 December 2015.

The Council Decision concluding the EU-Morocco Agricultural Agreement remains, therefore, valid. The EU institutions are meanwhile closely examining the full implications of the CJEU judgment.

The European Union recalls its support to the United Nations Secretary-General’s efforts to achieve a just, lasting and mutually acceptable political solution, which will provide for the self-determination of the people of Western Sahara in the context of arrangements consistent with the principles and purposes of the Charter of the UN.
