Asunto: Gibraltar y el derecho de libre circulación de los trabajadores

Los retrasos en la frontera terrestre entre España y Gibraltar causados por los controles españoles a los vehículos que entran o salen de España siguen teniendo graves repercusiones negativas. Se están viendo afectados miles de ciudadanos de la UE, en su mayoría de nacionalidad española. Muchos de estos trabajadores viven en España y trabajan en Gibraltar, por lo que tienen que desplazarse hasta Gibraltar cada mañana y volver a España cada tarde. Los retrasos ocasionados por los controles y las obras españolas afectan también a las personas que desean acceder a servicios a uno u otro lado de la frontera.

1. ¿No considera la Comisión que la situación en la frontera entre España y Gibraltar es contraria a los principios fundamentales de la UE de libre circulación de personas y servicios?

2. ¿Qué nuevas medidas propone adoptar la Comisión?

La Comisión remite a Sus Señorías a las respuestas dadas a las preguntas escritas E-009810/2014 y E-007507/2014.

Además de ello, tras una reunión técnica celebrada a principios de febrero de 2015, la Comisión está en contacto con las autoridades españolas en espera de información complementaria reclamada.

Subject: Gibraltar and then right of workers to move freely

The delays at the land border between Spain and Gibraltar caused by Spanish controls on vehicles entering or exiting Spain continue to have a severe negative impact. Thousands of EU nationals are affected, the majority of them Spanish nationals. Many of these workers live in Spain and work in Gibraltar, meaning that they have to commute into Gibraltar every morning and then back into Spain every evening. The delays caused by the controls and the Spanish works also affect people who wish to avail themselves of services on either side of the border.

1. Does the Commission not agree that the situation at the Spain-Gibraltar border is contrary to the fundamental EU principles of freedom of movement of persons and services?

2. What further action does the Commission propose to take?

The Commission refers the Honourable Members to its answers to written questions E-009810/2014 and E-007507/2014.

In addition, following a technical meeting beginning of February 2015, the Commission is in contact with the Spanish authorities in order to receive requested further information.
