Asunto: Acuerdo entre la Unión Europea y el Reino Unido sobre la colonia británica de Gibraltar
Tras la notificación del Reino Unido de su intención de abandonar la Unión Europea, el Consejo Europeo adoptó en marzo de 2017 las orientaciones que sirvieron de marco para las negociaciones de retirada, ya concluidas. En dichas orientaciones se explicitó que «ningún acuerdo entre la UE y el Reino Unido se podrá aplicar al territorio de Gibraltar sin acuerdo entre el Reino de España y el Reino Unido».
El 31 de diciembre, España y el Reino Unido alcanzaron un principio de acuerdo que debía servir de base para que la Comisión negociara en los seis meses siguientes un tratado específico sobre la colonia con el Reino Unido.
A pocos días de que venza el plazo acordado para la negociación de dicho acuerdo, y ante la importancia de aportar seguridad jurídica a la relación:
- ¿Cuándo prevé la Comisión que se adopte dicho tratado sobre Gibraltar?
- ¿Contemplará dicho acuerdo que España, como Estado miembro responsable del control de accesos al interior del espacio Schengen, ejerza el control de fronteras en el puerto y aeropuerto de Gibraltar?
- ¿Preverá la aplicación a Gibraltar de la normativa europea sobre el IVA e impuestos especiales como los relativos al tabaco, el alcohol o los carburantes?

El Acuerdo de Comercio y Cooperación entre la Unión Europea y el Reino Unido no se aplica a Gibraltar ni tiene efectos en su territorio.
España y el Reino Unido han debatido un marco para las relaciones futuras de Gibraltar con la Unión y lo han enviado a la Comisión, junto con una solicitud para iniciar el proceso de negociación de un acuerdo entre la Unión y el Reino Unido sobre Gibraltar.
En consonancia con la declaración de la Comisión adjunta a la Decisión del Consejo relativa a la firma, en nombre de la Unión, y a la aplicación provisional del Acuerdo de Comercio y Cooperación entre la UE y el Reino Unido1, la Comisión adoptó el 20 de julio de 2021 una Recomendación de Decisión del Consejo relativa a la apertura de negociaciones para la celebración de un acuerdo entre la UE y el Reino Unido con respecto a Gibraltar2.
En esta Recomendación, la Comisión propuso eliminar todos los controles y comprobaciones de personas y mercancías entre España y el territorio de Gibraltar, preservando al mismo tiempo plenamente la integridad del espacio Schengen y del mercado único. A tal fin, la Comisión propuso encomendar a España, como Estado de Schengen vecino, la realización de controles fronterizos en el puerto y aeropuerto de Gibraltar en el pleno respeto del acervo de Schengen. También propuso que el acervo de la Unión sobre el mercado único de bienes, incluido el impuesto sobre el valor añadido (IVA) sobre bienes y servicios y la legislación sobre impuestos especiales, se aplique a Gibraltar y en Gibraltar.
Las negociaciones con el Reino Unido podrían iniciarse después de que el Consejo autorice su apertura y adopte directrices de negociación.

Subject: EU-UK agreement on the British colony of Gibraltar
Following the United Kingdom’s notification of its intention to leave the European Union, the European Council adopted guidelines in March 2017 which served as a framework for the – now concluded – withdrawal negotiations. These guidelines stated that no agreement between the EU and the United Kingdom could apply to the territory of Gibraltar without there being an agreement between the Kingdom of Spain and the United Kingdom.
On 31 December, Spain and the United Kingdom reached an agreement in principle which should serve as a basis for the Commission to negotiate a specific treaty on the colony with the United Kingdom within the subsequent six months.
With but a few days to go till the expiry of the period agreed for the negotiation of such an agreement, and given the importance of providing legal certainty to the relationship:
- When does the Commission envisage that such a treaty on Gibraltar will be adopted?
- Will this agreement mean that Spain, as the Member State responsible for controlling access to the Schengen area, will be responsible for border controls at the port and airport of Gibraltar?
- Will it provide for the application to Gibraltar of EU rules on VAT and excise duties such as those relating to tobacco, alcohol and fuels?

The Trade and Cooperation Agreement between the European Union (EU) and the United Kingdom (UK) does not apply to Gibraltar nor has any effects on its territory.
Spain and the UK have discussed a framework for Gibraltar’s future relationship with the EU and have transmitted to the Commission this framework, together with a request to initiate the procedure for the negotiation of an EU-UK agreement on Gibraltar.
In line with the Commission’s statement attached to the Council Decision on the signing, on behalf of the Union, and on provisional application of the Trade and Cooperation Agreement between the EU and the UK1, the Commission adopted on 20 July 2021 a recommendation for a Council decision on opening the negotiations for an EU-UK agreement in respect of Gibraltar2.
In this recommendation, the Commission proposed removing all checks and controls on persons and goods between Spain and the territory of Gibraltar, while preserving fully the integrity of the Schengen area and of the single market. To this end, the Commission proposed entrusting Spain, as the neighbouring Schengen State, with performing border checks in full compliance with the Schengen acquis at Gibraltar port and airport. It also proposed that the Union acquis on the single market for goods, including value-added tax (VAT) on goods and services and excise legislation, is applied to and in Gibraltar.
Negotiations with the UK could start after the Council authorises the opening of the negotiations and adopts negotiating directives.
