1) ¿Tiene constancia la Comisión de cuántas veces se ha reunido el Grupo de Trabajo sobre el Artículo 50, ya sea dentro o fuera del edificio Berlaymont, con el ministro principal o Gobierno de Gibraltar, o con autoridades, representantes legales o grupos de presión vinculados a este territorio, incluyendo, si fuera el caso, el negociador principal Michel Barnier, la negociadora principal adjunta Sabine Weyand o cualquier integrante de su equipo, y, si es así, en cuántas ocasiones, en qué lugar y fecha, y con qué objeto tuvieron lugar estas reuniones?

 

2) ¿Puede la Comisión confirmar o desmentir la participación direc ta o indirecta del Gobierno de Gibraltar en la redacción final del acuerdo de retirada, en particular en la del artículo 184, bien a través de su ministro principal o miembros del Gobierno, bien a través de otras autoridades, representantes legales o grupos de presión vinculados a Gibraltar?

 

3) ¿Puede la Comisión encontrar una explicación razonable a que el ministro principal de un territorio suje to a descolonización y que oficialmente no pertenece a ningún Estado miembro de la Unión como es Gibraltar tuviese acceso al borrador del acuerdo de retirada del Reino Unido antes que el jefe de Gobierno de un Estado miembro como España?

1. En relación con la primera parte de su pregunta sobre el número de reuniones entre el Grupo de trabajo sobre el artículo 50 con el ministro principal o el Gobierno de Gibraltar, o con autoridades,

representantes legales o grupos de presión vinculados a ese territorio, tenga en cuenta que ese grupo de trabajo es una formación del Consejo. Por consiguiente, esta pregunta debe dirigirse a la Secretaría del Consejo. En cuanto a las reuniones entre el negociador principal Michel Barnier, la negociadora principal adjunta y cualquier integrante de su equipo con el ministro principal del Gobierno de Gibraltar, o con autoridades, representantes legales o grupos de presión vinculados a ese territorio, la Comisión puede informar a su señoría de que el 13 de julio de 2017 se celebró una reunión entre el ministro principal y el negociador principal adjunto de la UE en el edificio Berlaymont. Esta reunión se produjo a petición del ministro principal. El objetivo de la reunión desde el punto de vista de la UE era escuchar las preocupaciones expresadas y explicar las directrices del Consejo Europeo de abril de 2017.

 

2. Sobre la segunda pregunta, la Comisión puede garantizar a su señoría que la redacción del acuerdo de retirada en todas sus partes es el resultado de un proceso de negociación llevado a cabo

únicamente entre los negociadores de la UE y del Reino Unido.

Subject: Article 50 Working Group meetings with Gibraltar authorities and pressure groups

 

In light of the statements by the UK Prime Minister on the role of the Government of Gibraltar in the Brexit negotiations:

 

(1) Does the Commission know how many times the Article 50 Working Group has met, whether inside or outside the Berlaymont building, with the Chief Minister or the Government of Gibraltar, or with authorities, legal representatives or pressure groups linked to the territory, including meetings with the chief negotiator Michel Barnier, the deputy chief negotiator Sabine Weyand and any member of their team, and, if such meetings have taken place, on how many occasions, where and when and for what purpose were they held?

 

(2) Can the Commission confirm or deny the direct or indirect participation by the Government of Gibraltar in the final drafting of the Withdrawal Agreement, in particular Article 184, either through its Chief Minister or members of the Government or through other authorities, legal representatives or pressure groups linked to Gibraltar?

 

(3) Can the Commission offer a reasonable explanation as to why the Chief Minister of a territory subject to decolonisation and which does not officially belong to any EU Member State, as is the case with Gibraltar, would have access to the draft UK Withdrawal Agreement earlier than the Head of Government of a Member State such as Spain?

1. Regarding the first part of your question on the number of meetings between the Article 50 Working Group with the Chief Minister or the Government of Gibraltar, or with authorities, legal representativesor pressure groups linked to the territory, please note that this working group is a Council formation. Therefore this question should be addressed to the Council Secretariat. As regards meetings between the Chief Negotiator Michel Barnier, the Deputy Chief Negotiator and any member of their team with the Chief Minister of the Government of Gibraltar, or with authorities, legal representatives or pressure groups linked to the territory, the Commission can inform the Honourable Member that one meeting between the Chief Minister and the Deputy Chief EU negotiator took place on 13 July 2017 in the Berlaymont. This meeting was at the request of the Chief Minister. The purpose of the meeting on the EU side was to listen to the concerns expressed and explain the European Council guidelines of April 20171.

 

2. On the second question, the Commission can assure the Honourable Member that the drafting of the Withdrawal Agreement in all its parts is the result of a negotiation process that was conducted solely between the EU and the United Kingdom (UK) negotiators.

 

3. The Commission has no elements to confirm or deny the information provided by the Honourable Member in his third question, including whether or not the UK government may have shared the draft Withdrawal Agreement with the Chief Minister of Gibraltar, as part of the UK’s responsibility for the external relations of this territory.
