Asunto: Mecanismos de acompañamiento para la zona del Campo de Gibraltar tras el acuerdo UE–Reino Unido sobre Gibraltar
En el contexto del futuro acuerdo entre la Unión Europea y el Reino Unido sobre Gibraltar, diversos sectores sociales, sindicales y económicos del Campo de Gibraltar han planteado preocupaciones sobre los efectos socioeconómicos derivados de la eliminación de la Verja y del nuevo marco de relaciones.
Se formulan por tanto las siguientes preguntas a la Comisión:
- 1.En primer lugar, existe incertidumbre sobre el futuro de la actividad aduanera que, durante años, ha generado empleo directo para decenas de personas. ¿Contempla la Comisión mecanismos de compensación o transición para los trabajadores afectados por la desaparición de dicha frontera física?
- 2.En segundo lugar, persiste un problema estructural con las pensiones de los trabajadores transfronterizos que han cotizado en Gibraltar, donde las contribuciones son reducidas. ¿Qué instrumento prevé utilizar la Comisión para corregir ese desequilibrio y garantizar pensiones dignas para estos trabajadores?
- 3.Por último, organizaciones como el Grupo Transfronterizo y el Comité Sindical Interregional del Sur han reclamado la creación de un observatorio de seguimiento del acuerdo y una oficina EURES en La Línea de la Concepción. ¿Considera la Comisión que estas herramientas pueden contribuir al desarrollo de una zona de prosperidad compartida y al equilibrio socioeconómico entre Gibraltar y el Campo de Gibraltar?

Los textos jurídicos del futuro Acuerdo entre la UE y el Reino Unido con respecto a Gibraltar está en proceso de finalización.
El objetivo principal del futuro Acuerdo es garantizar la prosperidad de toda la región del Campo de Gibraltar y Gibraltar. Esto se hará eliminando todas las barreras físicas para las personas y las mercancías que circulen entre España y Gibraltar, preservando al mismo tiempo el espacio Schengen, el mercado único de la UE y la unión aduanera.
El Acuerdo tendrá en cuenta la situación particular de la región y garantizará la protección de los derechos de los trabajadores transfronterizos. Los trabajadores fronterizos tendrán derecho a entrar y salir de Gibraltar y España, así como a residir en el lugar mientras desempeñen su trabajo. Por lo que respecta a las pensiones, se aplicarán las normas de coordinación de la seguridad social: que se limitan a reflejar el nivel nacional de las pensiones. Los complementos serían competencia del Derecho nacional.
El futuro Acuerdo también tiene por objeto incluir un mecanismo financiero para promover la cohesión entre Gibraltar y el Campo de Gibraltar, por ejemplo, en materia de formación y empleo. Con respecto a la Red Europea de Servicios de Empleo (EURES), corresponde a los Estados miembros decidir sobre la asignación de consejeros EURES para sus trabajadores nacionales, también en España. Los consejeros podrían proporcionar información y orientación a los trabajadores afectados.

Subject: Support mechanisms for the Campo de Gibraltar area following the EU-UK agreement on Gibraltar
In view of the forthcoming EU-UK agreement on Gibraltar, a number of social, trade union and economic sectors in Campo de Gibraltar have raised concerns about the socio-economic impact of the dismantling of the land border and the new framework for relations.
In view of this:
1. Firstly, there is some uncertainty about the future of customs activities, which for years have directly employed dozens of people. Does the Commission envisage putting in place any compensation or transition mechanisms for those workers affected by the disappearance of the physical border?
2. Secondly, there is still a structural problem with the pensions of cross-border workers who have paid contributions in Gibraltar, where rates are lower. What instrument Will the Commission use to correct this imbalance and ensure that these workers receive decent pensions?
3. Finally, organisations such as the Cross-Frontier Group and the Interregional Trade Union Council South have called for the establishment of an observatory to monitor the agreement and a EURES office in La Línea de la Concepción. Does the Commission believe that these tools would contribute to the development of an area of shared prosperity and comparable socio-economic conditions in Gibraltar and Campo de Gibraltar?

The finalisation of the legal texts of the future EU-United Kingdom Agreement in respect of Gibraltar is ongoing.
The main objective of the future Agreement is to secure the prosperity of the whole region of Campo de Gibraltar and Gibraltar. This will be done by removing all physical barriers for persons and goods circulating between Spain and Gibraltar, while preserving the Schengen area, the EU Single Market and Customs Union.
The Agreement will take into account the unique situation of the region and ensure the protection of cross-border workers’ rights. Frontier workers will have the right to enter and leave Gibraltar and Spain, as well as reside there during their work. As regards pensions, social security coordination rules will apply: these rules merely reflect the national level of pensions. Any top-ups would be a matter for national law.
The future Agreement also aims at including a financial mechanism to promote cohesion between Gibraltar and the Campo de Gibraltar, for example on matters of training and employment. With respect to the European Employment Services (EURES), it is up to the Member States to decide on the allocation of EURES advisers for their national workers, including in Spain. They could provide information and guidance to the workers concerned.
