Asunto: Rellenos en Lugar de Importancia Comunitaria por Gibraltar
En la pasada legislatura ya se presentaron numerosas preguntas (E007437/2013; E007803/2012; o E004560 y E 0012441/2011) inquiriendo acerca de diversos riesgos ambientales que podría estar causando Gibraltar mediante rellenos de tierras en una zona declarada por la Comisión como «Lugar de Importancia Comunitaria» mediante la Decisión 2009/95, de 12 de diciembre (ES6120032), y que el Gobierno español protegió declarándola «Zona especial de conservación» mediante Real Decreto 1620/2012. Dichos rellenos podrían estar provocando daños ecológicos irreparables como han denunciado ante la Comisión asociaciones ecologistas de la zona.
Mientras que la Comisión ha respondido invariablemente a estas preguntas diciendo que solicitaría información a las autoridades británicas, los rellenos han proseguido.
1. ¿Ha tenido acceso la Comisión al estudio de impacto medioambiental británico con respecto a la situación actual de las infraestructuras creadas por estos rellenos?
2. ¿Piensa la Comisión adoptar alguna medida ejecutiva, más allá de pedir explicaciones a las autoridades británicas, para impedir que Gibraltar prosiga produciendo daños a una zona con protección comunitaria?
3. ¿Piensa la Comisión adoptar alguna medida para que Gibraltar proceda a reparar el daño medioambiental causado, retrotrayendo los rellenos realizados?

La Comisión ha recibido y analizado una serie de reclamaciones contra el Reino Unido por la realización de varias actuaciones en y frente a la costa de Gibraltar, en particular el relleno de terrenos como parte del proyecto Eastside (también conocido como proyecto Sovereign Bay) y las actividades llevadas a cabo en la Playa del Algarrobo (Sandy Bay), cerca del proyecto Eastside.
Durante su análisis, la Comisión solicitó a las autoridades del Reino Unido aclaraciones, entre otras cosas sobre la evaluación del impacto ambiental del proyecto en el entorno que lo rodea. Las autoridades del Reino Unido indicaron que, según su evaluación, el proyecto no tenía impactos ambientales significativos en ese lugar. Además, las autoridades británicas explicaron cómo tuvieron en cuenta el impacto del proyecto Eastside y de los rellenos en la evaluación del estado medioambiental actual conforme a lo dispuesto en el artículo 8 de la Directiva 2008/56/CE(1), sobre la estrategia marina, y aclararon que la declaración ambiental (presentada a la Comisión) contempla en detalle los rasgos y los impactos transfronterizos del proyecto.
Tras examinar toda la información y las posiciones expuestas sobre esta cuestión basándose en las pruebas presentadas, la Comisión ha sido incapaz de detectar ningún incumplimiento de la legislación medioambiental de la UE. Por consiguiente, las respuestas a las preguntas tercera y cuarta son negativas.

Subject: Land reclamation by Gibraltar on a site of Community interest
A number of questions were tabled during the last legislative term (E007437/2013; E007803/2012; E004560 and E 0012441/2011) concerning various environmental hazards which could arise as a result of land reclamation work by Gibraltar in an area designated by the Commission as a ‘site of Community interest’ in Decision 2009/95 of 12 December 1995 (ES6120032). To protect this area the Spanish Government also designated it a ‘Special conservation area’ in Royal Decree 1620/2012. Ecology associations in the area have complained to the Commission that this land reclamation work could be causing irreparable ecological damage.
The Commission’s invariable response to these questions was to say it would request information from the British authorities; meanwhile, land reclamation work has continued.
1. Has the Commission been granted access to the British environmental impact study on the current state of the infrastructure created by the land reclamation work?
2. Rather than simply seeking explanations from the British authorities, is the Commission thinking of adopting an executive measure of some kind to prevent Gibraltar continuing to damage an area under Community protection?
3. Is the Commission thinking of adopting a measure of some kind to ensure Gibraltar puts right the environmental damage caused, restoring reclaimed areas to their original state?

The Commission has received and assessed complaints against the United Kingdom for several activities in and off the coast of Gibraltar, including the land reclamation works under the Eastside Project (also known as Sovereign Bay Project) and activities in Sandy Bay (Playa del Algarrobo) near the Eastside Project.
In the course of its assessment, the Commission requested clarification from the UK authorities inter alia on the impact assessment of the project on the surrounding environment. The UK authorities indicated that according to their assessment the project would not have any significant environmental effects on this site. Furthermore, the UK authorities set out how the impacts of the Eastside Project and land reclamation activities were considered in the assessment of the current environmental status in accordance with Article 8 of the Marine Strategy Framework Directive 2008/56/EC(1) and clarified that the transboundary impacts and features of that project were considered in detail in the Environmental Statement, which has been provided to the Commission services.
Having considered all the information and standpoints provided on this issue and, based on the evidence produced, the Commission has not been able to identify any breach of EU environmental legislation. Therefore, the answers to the second and third questions are negative.
