Recientemente, hemos conocido el texto del acuerdo sobre Gibraltar entre el Reino Unido, España y la Unión. Dicho texto no resuelve muchas de las controversias principales en la relación entre el Peñón y los municipios vecinos del Campo de Gibraltar, principalmente las relativas a fiscalidad o medioambiente.

Por un lado, el acuerdo no fija medidas sobre los rellenos de Gibraltar en el proyecto Eastside, que están provocando consecuencias negativas sobre zonas especiales de conservación (ZEC) de la UE, la pesca de la zona y la conservación del litoral.

Por otro, el texto no concluye cómo proteger la competitividad de puertos europeos vecinos, como Algeciras, frente al de Gibraltar, lo que permite el repostaje (bunkering) y la existencia de fondeaderos exteriores en aguas gibraltareñas, y mantiene la falta de reciprocidad en el derecho de establecimiento empresarial entre Gibraltar y la Unión o la ausencia del régimen de comercio de derechos de emisión en Gibraltar, todo esto mientras persisten situaciones de competencia desleal entre los puertos de la zona.

Ante esta situación:

  • 1. ¿Va a permitir la Comisión que Gibraltar siga lanzando rellenos sobre las ZEC de la Unión?
  • 2. ¿Ha evaluado cómo afectarán a la competitividad de puertos europeos vecinos las diferencias medioambientales y fiscales que mantiene el acuerdo?

El futuro Acuerdo entre la UE y el Reino Unido con respecto al Acuerdo sobre Gibraltar, una vez aplicado, no afectará a la cuestión a la que se refieren sus señorías.

El futuro Acuerdo entre la UE y el Reino Unido con respecto a Gibraltar contiene disposiciones sólidas en materia de igualdad de condiciones en relación con las ayudas estatales, la fiscalidad, las normas laborales y sociales, el medio ambiente, el clima y el desarrollo sostenible. Estas disposiciones tienen por objeto evitar distorsiones de la competencia que afecten a las partes interesadas de la UE, incluidos los puertos de la UE. Por lo que se refiere a la fiscalidad, el medio ambiente, el clima y las normas sociales y laborales, el Acuerdo establece una cláusula de no regresión que garantiza que las partes no puedan debilitar o reducir el nivel de protección en los distintos ámbitos por debajo del nivel vigente a 31 de diciembre de 2020 que afecte al comercio o la inversión. En concreto, por lo que se refiere al comercio de derechos de emisión, el Acuerdo (artículo 220, apartado 2) establece que el Reino Unido, con respecto a Gibraltar, velará por que dicho sistema o medidas tengan un ámbito de aplicación y efectividad equivalentes a los del sistema vigente en la Unión en el momento de la entrada en vigor del Acuerdo.

Subject: Consequences for Andalusia of the agreement on Gibraltar between the United Kingdom, Spain and the European Union

We recently learned about the text of the agreement on Gibraltar between the UK, Spain and the EU. This text does not resolve many of the main disputes in the relationship between Gibraltar and the neighbouring municipalities of Campo de Gibraltar, mainly those relating to taxation or the environment.

For one thing, the agreement contains no measures concerning Gibraltar’s land reclamation activities in the Eastside project, which are having negative consequences on EU Special Areas of Conservation (SAC), fishing in the area and coastal conservation.

Furthermore, the text fails to address how to protect the competitiveness of neighbouring EU ports, such as Algeciras, in the face of Gibraltar’s port, which allows bunkering and external anchorage in Gibraltarian waters. It also maintains the lack of reciprocity in the right of business establishment between Gibraltar and the EU, and the emissions trading scheme remains absent in Gibraltar, all while situations of unfair competition between ports in the area persist.

In view of the above:

  • 1. Will the Commission allow Gibraltar to continue land reclamation activities on the EU’s SACs?
  • 2. Has it assessed how the environmental and taxation differences maintained by the agreement will affect the competitiveness of neighbouring EU ports?

The future EU-UK Agreement in respect of Gibraltar agreement, once applied, will not affect the issue referred to by the Honourable Members.

The future EU-UK Agreement in respect of Gibraltar contains solid Level Playing Field provisions regarding state aid, taxation, labour and social standards, environment, climate and sustainable development.

These provisions are aimed at preventing distortions of competition affecting EU stakeholders, including EU ports. As regards taxation, environment, climate, social and labour standards, the Agreement provides for non-regression which ensures that parties cannot weaken or reduce the level of protection in the different areas below the level in place on 31 December 2020 affecting trade or investment.

Specifically, as regards emissions trading, the Agreement (Article 220(2)) provides that the UK, in respect of Gibraltar, shall ensure that such system or measures shall have an equivalent scope and effectiveness as the one in place in the EU at the time of the entry into force of the Agreement.
