Asunto: Rechazo de las Cortes Generales de España al Acuerdo entre la UE y el Reino Unido con respecto a Gibraltar
El pasado 13 de abril la Comisión Mixta Congreso-Senado para la Unión Europea de las Cortes Generales de España aprobó una resolución para instar al Gobierno a rechazar el Acuerdo entre la UE y el Reino Unido con respecto a Gibraltar[1].
Las Cortes Generales, que tienen la potestad constitucional para autorizar o no la celebración de tratados internacionales que obliguen al Estado, ha rechazado el Acuerdo por ser contrario a la reivindicación española de la soberanía sobre la colonia inglesa, que obtiene un régimen mucho más favorable que el que tenía cuando Reino Unido formaba parte de la Unión Europea y del que el Tratado de Utrecht concedía al Peñón. También ha condenado el Acuerdo por la falta de equiparación fiscal entre el Peñón y el Campo de Gibraltar.
Las Cortes Generales rechazan el Acuerdo, además, porque el Gobierno infringe la Constitución al no someterlo a previa autorización.
Por todo ello, la Comisión:
- 1.¿Mantiene su intención de aprobar un tratado que no ha sido autorizado por las Cortes Generales del Estado miembro afectado y que ostenta un título de soberanía sobre Gibraltar?
- 2.¿Considera que la simple autorización del Parlamento Europeo la exime de la obligación de acudir al Parlamento nacional del Estado afectado?

El Acuerdo UE-Reino Unido con respecto a Gibraltar representa el último elemento que completa el marco jurídico de las relaciones entre la UE y el Reino Unido tras el Brexit. La base jurídica para la celebración del Acuerdo UE-Reino Unido con respecto a Gibraltar es el artículo 217 del Tratado de Funcionamiento de la Unión Europea (TFUE)[1], según el cual la UE tiene competencia para celebrar acuerdos de asociación con terceros países.
El procedimiento de celebración de acuerdos de asociación está previsto en el artículo 218 del TFUE[2]. Sobre esta base, el Consejo adopta la decisión por la que se autoriza la firma del acuerdo y su aplicación provisional, y también corresponde al Consejo celebrar el acuerdo, previa aprobación del Parlamento Europeo. El Consejo adopta estas decisiones por unanimidad. Se utilizó el mismo procedimiento para la celebración del Acuerdo de Comercio y Cooperación entre la UE y el Reino Unido[3]. 2. El Acuerdo entre la UE y el Reino Unido con respecto a Gibraltar dispone que este se entenderá sin perjuicio de las posiciones jurídicas de España y del Reino Unido en relación con la soberanía y la jurisdicción, y que no servirá de base para ninguna afirmación o denegación de la soberanía, ni siquiera en procedimientos judiciales o de otro tipo.

Subject: Rejection by the Spanish Parliament of the Agreement between the EU and the United Kingdom in respect of Gibraltar
On 13 April 2026, the Joint Congress-Senate Committee on the European Union of the Spanish Cortes Generales adopted a resolution urging the Government to reject the EU-UK Agreement in respect of Gibraltar[1].
The Cortes Generales, which, pursuant to the Constitution, have the power to give or withhold approval for the conclusion of international treaties that are binding upon the State, have rejected the Agreement on the grounds that it runs counter to the Spanish claim of sovereignty over the British colony, which is afforded a much more favourable regime than it enjoyed during the United Kingdom’s membership of the European Union, and indeed than that stipulated under the Treaty of Utrecht. It also condemned the Agreement for failing to equalise taxation between the Gibraltar and Campo de Gibraltar.
The Cortes Generales also rejected the Agreement on the grounds that the Government is in breach of the Constitution by not submitting it for prior approval.
In light of the above:
- 1.Does the Commission still intend to ratify a treaty which has not been approved by the Parliament of the Member State concerned and which holds the title of sovereignty over Gibraltar?
- 2.Does it consider that the mere approval by the European Parliament dispenses with the obligation to seek the approval of the national parliament of the State concerned?

- The EU-United Kingdom Agreement in respect of Gibraltar represents the last element that
completes the legal framework of the relations between the EU and the United Kingdom
following Brexit. The legal basis for the conclusion of the EU-United Kingdom Agreement in
respect of Gibraltar is Article 217 of the Treaty on the Functioning of the European Union
(TFEU)1, according to which the EU has competence to conclude association agreements with
third countries.
The procedure for the conclusion of association agreements is foreseen in Article 218 TFEU2.
On this basis, the Council takes the decision authorising the signature of the agreement and its
provisional application and it is also for the Council to conclude the agreement, after
obtaining the consent of the European Parliament. These decisions are adopted by the Council
by unanimity. The same procedure was used for the conclusion of the EU-United Kingdom
Trade and Cooperation Agreement3. - The EU-United Kingdom Agreement in respect of Gibraltar states that it shall be without
prejudice to legal positions of Spain and the United Kingdom with regard to sovereignty and
jurisdiction and shall not constitute the basis for any assertion or denial of sovereignty
including in legal proceedings or otherwise.
